SANDOZ MyJCV Program Patient Terms of Service

The SANDOZ MyJCV Program (Program) supports patients who require testing for antibodies to the John Cunningham Virus (JCV) to manage the risk of Progressive Multifocal Leukoencephalopathy (PML). Patients enrolled by their healthcare professional into the Program via the web portal (MyJCV Portal) are offered the smartphone application (MyJCV Check App). The app can send reminders when testing is due and provide electronic pathology request forms (e-requests) and other helpful information.

By enrolling in the Program, you agree to these terms of service. If you do not agree to these terms of service, your enrolment in the Program will not proceed and none of your personal information will be collected. 

Program administration:

  1. The Program is sponsored by Sandoz Pty Ltd (the Company) and is administered by an authorised third-party provider.

  2. The Program is administered by Medical Safety Systems Corporate Pty Ltd trading as “RxMx Australia” ABN 89 608 630 931 (Administrator). Sandoz may change the Administrator from time to time and will notify you of this.

Eligibility:

  1. You are only eligible to enrol in the Program if you require anti-JCV antibody testing and you meet the eligibility criteria set out in the Program materials or otherwise notified by the Company.

  2. Additional eligibility criteria are included in Program materials or may be notified to you by the Company.

Enrolment:

  1. If you are enrolled by your treating specialist, s/he will update the MyJCV Portal with your personal information (e.g. name, email address, telephone number). The MyJCV Portal is a secure password protected portal, that is only available to your treating specialist, additional care team users nominated by your treating specialist (e.g. clinic nurses, clinic administrators or other authorised personnel and the Administrator).

  2. You also consent to the collection, storage, use and disclosure of your personal information and other matters set out in the Administrator’s privacy policy, available at https://rxmxcorp.com/services-privacy/, and the Program Privacy Statement outlined below.

  3. Once enrolled, you may opt out of the Program, by contacting the Administrator via email contact@rxpx.health. If you opt out of the Program, the Administrator may continue to hold personal information collected from you for purposes permitted by law.

Patient services:

  1. Under the Program, you may receive the following services:

  2. MyJCV Check App (App) – allows patients to view e-requests and receive reminders.

  3. Pathology Reminders – the app will send reminders 30 days before, 7 days before and on the due date of your next JCV blood test. If testing is not completed, a reminder will be sent 7 days after the test was due.

  4. Electronic Requests – electronic pathology requests (e-requests) for JCV blood testing.

    Please note that services provided under this Program are intended to support your anti-JCV antibody test monitoring workflow. The Program is complementary and not intended to replace your treating specialist or any other healthcare professional.

Variations or termination and no liability:

  1. The Company may at any time:
    - terminate the Program for any reason;
    - include additional services as part of the Program; or
    - vary or discontinue services offered under the Program.

  2. The Company and the Administrator will not bear any liability resulting from the cessation, termination or variation under clause 3 of this section. 

  3. To the fullest extent permitted by law, the Company and the Administrator will not be liable for any direct or indirect loss or damage suffered by you or a patient (or their parent/guardian) because of the Program, including in connection with (i) reliance on the content or on a function of the Portal or App; or (ii) use of or inability to use the Portal or any App; or (iii) any failure to perform a function; or (iv) errors and omissions in the content of the Portal or any App.

Use of Program software:

  1. The Program software is not a medical device. It is intended to be used for information and education purposes only.

  2. Information accessed via the software is not intended to offer personalised medical diagnosis or patient-specific treatment advice. 

  3. All software included in the Program is owned by the Administrator and was developed in collaboration with the Company. You are granted a non-exclusive licence to download, install, access and use the software solely in relation to your enrolment in the Program. You must not use the software for any purpose other than as expressly permitted under these terms of service. You do not acquire ownership of any intellectual property rights or any other commercial benefits in connection with your use of the software.

  4. When using the software you are responsible for:
    - ensuring that you are using the latest available version;
    - any damage to your devices, and any loss or corruption of information that you store in the devices that results from the use of the software or the interaction of the software with other applications, data or programs that you may download or use; and
    - maintaining the physical security of your devices and integrity of your data.

  5. You must not:
    - modify, edit, improve, resell, reverse engineer, change or otherwise interfere with the operation of the software in any way;
    - engage in systematic copying and widespread distribution of content in the software to the public; or
    - violate these terms of service.

  6. Because the Company has no control over and does not endorse the content of any websites to which the Program software may be linked, you agree that your access to such other websites is at your own risk. The company accepts no liability for the accuracy or legality of the content on third party sites. The Company accepts no liability regarding third party privacy practices.

No warranty

  1. To the maximum extent permitted by law, the Administrator makes no representations, warranties, conditions or undertakings of any kind, express or implied, regarding the Services and/or any content, products or features provided, performance, merchantability, or fitness for a particular purpose, all of which are provided on an “as is” and “as available” basis. By continuing to use the Services, you accept that their overall quality and performance may vary. The Administrator is not responsible for late, lost, incomplete, illegible, misdirected or stolen messages or mail, unavailable network connections, failed, incomplete, garbled or delayed computer transmissions, on-line failures, hardware, software or other technical malfunctions or disturbances or any other communications failures or circumstances affecting, disrupting or corrupting communications. The Administrator assumes no responsibility, and will not be liable for, any damages to, or any viruses affecting your computer equipment or other property on account of your access to, use of, or browsing on the services or your downloading of any content from the services.

Applicable law

  1. These Terms of Service shall be governed by the laws of New South Wales, Australia.

MyJCV Program Patient Privacy Statement

The Program will be administered via an online platform accessed by your treating specialist.

The Portal will collect your personal information include the following:
•    Full name;
•    Date of birth;
•    Gender;
•    Contact telephone number;
•    Email address;
•    Residential address;
•    Postal address; and
•    Laboratory testing results.

By providing your personal information to the Administrator, you consent to the personal information being used for the purposes of administering and managing the Program, including:

  • Invitation via email to download and access the App

  • Processing laboratory tests with third party pathology providers

  • The Administrator providing to the Company de-identified reports including your initials and details of the relevant healthcare provider so the Company can comply with its quality or safety requirements or for audit or inspection purposes. Beyond scope of this de-identified information, the Company will not receive any additional information about you from the Administrator. 

The Administrator otherwise reserves the right to use aggregated and de-identified data collected via the Program for internal purposes, including planning and managing resources for the Program, and analysis and research purposes.

The Administrator may disclose this information to third parties in order to promote awareness of the Program and to publish the information in reports or medical publications. Your name will not be identified in any report or publication.

Your personal information will be stored in a Program database which is accessible by your treating specialist and additional care team users nominated by your treating specialist (e.g. clinic nurses, clinic administrators or other authorised personnel) in accordance with these terms and conditions. The Administrator may use your personal information to contact you for the purposes of carrying out the Program, to clarify certain aspects of your personal information or to review your experience or participation in the Program.

Personal information may be stored on servers located in jurisdictions outside of Australia and you consent to such export and storage. Some of those countries may not offer the same level of privacy protection as in Australia. However, the Company will enter into agreements with its third-party service providers to ensure personal information is secure and adequate data protection is provided.

You have the right to access, update or correct personal information provided to the Administrator under this Program.
