ORGANON® Care Patient Terms of Use
Effective as of: Jan 20, 2026
ORGANON Care (“the Program”) provides support services to patients who have been prescribed a specific Organon medication (“the Medication”). The Program offers educational materials, nurse support, and digital tools to support with use of the Medication (collectively, “Program Services”).
The Program is delivered subject to these Terms of Service (“Terms”). By enrolling in the Program, you acknowledge and agree to be bound by these Terms and the privacy collection statement and the privacy policy, either on your own behalf or, where applicable, as an appropriate parent, legal guardian, or carer for a patient who has been prescribed the Medication (subject to eligibility requirements identified below).
Administration:
1. The Program is sponsored and provided by Organon Pharma Pty Ltd (“Organon”) [ABN 54 637 107 512] (“the Company”) and administered by an authorised third-party provider appointed by the Company (“the Administrator”).
2. The current Administrator is Medical Safety Systems Corporate Pty Ltd, trading as RxMx Australia (ABN 89 608 630 931) (“RxMx”). The Company reserves the right to appoint a different Administrator at any time and will notify you if this occurs.
3. The Administrator facilitates the delivery of the Program and Program communications, including but not limited to the Program Platform (“App”), push notifications, phone calls, mail, email correspondence, and SMS messages.
Eligibility:
4. The Program is available only to Australian residents who have been prescribed Medication by their healthcare professional and who meet the eligibility criteria set out in the Program materials or as otherwise communicated by the Company.
5. The Program is not available to patients under 18 years of age, if the Medication is not indicated for paediatric use (i.e. patients under the age of 18 in Australia). If the Medication is indicated for paediatric use, the Program may be accessed by an appropriate parent, legal guardian or carer, subject to these Terms. In such case, the parent, legal guardian or carer will act as agent on behalf of the relevant patient in enrolling the patient into the Program and in using the App.
6. Additional eligibility requirements may be set out in the Program materials or communicated to you by the Company.
Enrolment
7. You may enrol in the Program only if you have been prescribed the Medication by your healthcare professional. To enrol, you must create a user profile which will include the provision of an email address for login management purposes and require the last four digits of your Medication barcode as verification, in addition to any other information required by the Administrator.
8. The App is a secure, password-protected platform accessible only by you, the Administrator, and other parties providing information technology services. The App can be downloaded from Apple or Google Play stores.
9. By enrolling in the Program, you consent to the collection, storage, use, and disclosure of your personal information in accordance with the Administrator’s Privacy Policy (available at https://rxmxcorp.com/services-privacy/), the Program Privacy Statement, and the Patient Safety Statement provided below.
10. Your enrolment in the Program will depend on the services you have elected to receive and is subject to these Terms.
11. Once enrolled, you may opt out of any aspect of, or the entirety of, the Program by completing the steps to opt out in the App, or contacting the Administrator through the contact details provided in the App.
12. If you opt out of the Program, the Administrator may continue to retain personal information collected from you as permitted by law, including for purposes such as enabling the Company to report to relevant health authorities.
Duration of the Program
13. Your enrolment in the Program will automatically cease upon the earliest of the following events:
You choose to opt out of the Program; or
The Company or Administrator discontinues the Program; or
The Company or Administrator removes you from the program.
Program Services
14. Under the Program, you may opt in to receive a range of services, which may include (but are not limited to):
Coordination of Patient Injection Training – The Administrator may provide access to educational resources and, where applicable, arrange training to ensure you understand how to self-administer your Medication safely and effectively.
Telephone support – You may arrange, via the App chat function, for a support nurse to contact you by telephone to provide educational information and adherence support relating to your Medication.
Patient smartphone/tablet application (App) – Upon acceptance of these Terms, you will receive user access to the App. The App allows you to record personal and medication-related information for your own reference and program support purposes.
Reminders & Notifications – The App may provide reminders for upcoming doses, appointments, or tests to support treatment adherence.
Educational Materials – The Program may provide access to educational materials regarding your treatment, including administration instructions, disease management information, and safety guidance.
Technical Support – Technical assistance for accessing the App may be provided by the Administrator.
Feedback/Surveys – You may be invited to provide feedback about the Program to help improve the services offered.
Limitations of the Services – The Program and App are intended to provide educational, logistical, and support services only. They do not replace professional medical advice, diagnosis, or treatment, and you should always follow the instructions of your healthcare professional.
15. You are only entitled to access the Program services while you are using your Medication and remain under the care of a healthcare professional.
16. The Program services are intended to support the advice of your healthcare professional. They are not a substitute for professional medical advice, diagnosis, or treatment, and do not replace or alter the instructions provided by your healthcare professional or any other healthcare professional.
Medical Information/ Conditions
17. The Program is intended to be a tool solely for your personal use. While there may be general information on the Program related to certain medical conditions and/or their treatment and the nurse support component of the patient program (as applicable), should a medical condition exist, this App is not to be used as a substitute for medical judgment, advice, diagnosis or treatment of any health condition or problem.
18. In using the Program, you agree that subject to clauses 21 and 22, neither the Company nor the Administrator is, or will be, liable or otherwise responsible for any decision made or any action taken or any action not taken due to your use of this Application.
19. The Program is not intended to diagnose, prevent, monitor, treat, mitigate, cure or prevent any disease. Please consult with your doctor or other qualified health care professional before relying on the content of the Program.
Variations, Termination, and Liability
20. The Company may at any time, at its discretion:
Cease funding or terminate the Program for any reason;
Terminate your participation in the Program;
Include additional services as part of the Program; or
Vary or discontinue services offered under the Program.
21. The Company and the Administrator will not be liable for any consequences arising from the cessation, termination, or variation of the Program or its services under clause 18.
22. To the fullest extent permitted by law, the Company and the Administrator will not be liable for any direct or indirect loss or damage you may suffer in connection with the Program, including but not limited to:
Reliance on the content or functionality of the App;
Use of, or inability to use, the App; or
Any failure to perform a function, errors, or omissions in the content of the App.
Warranties and Liability
23. The Program, including the App (collectively, “Program software”), is provided on an “as is” and “as available” basis. The Company makes no warranties, representations, or guarantees regarding the content, functionality, or performance of the Program software. The Program software may contain information derived from third-party sources, and the Company does not guarantee the accuracy, completeness or currency of such information. The Company and the Administrator do not endorse and are not responsible for the content, practices, or standards of third-party sources. Any material or data obtained through use of the Application is at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such content or material.
24. Nothing in these Terms limits, excludes or modifies, or purports to limit, exclude or modify, consumer guarantees provided under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). Except for liability that cannot be excluded by law, the Company and the Administrator each disclaim all warranties of any kind, whether express, implied or statutory regarding the Application, including any implied warranty of non-infringement of third-party rights.
25. The Administrator has taken steps to ensure that the technical functions of the App perform as intended when used with the specific version(s) of the operating system and the specific device(s) for which the Application was designed. The Administrator and the Company make no representation regarding the functions or interoperability of the Application when used with subsequent versions of that operating system, with other operating systems or with other devices.
26. The App is not a substitute for analysis by a doctor or healthcare professional based on an individualised medical examination and/or specific clinical examinations. It does not provide individualised diagnosis, monitoring or treatment recommendations and you agree not to rely on it for such purposes.
27. To the maximum extent permitted by law, you agree that neither the Company nor the Administrator shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, however caused and on any theory of liability, except for liability that cannot be excluded by law. This includes damages for personal injury, lost data, lost profits, or business interruption arising from or relating to: (i) your use of the App or use of the App through your account by anyone else, or your use of any third party content; (ii) the cost of procurement of substitute data, information or software; (iii) unauthorised access to or alteration of your transmissions or data; or (iv) any other matter relating to the App or its use. Additionally, you are solely responsible for any and all decisions regarding use of the App to input, store and/or transfer personal data. To the extent permitted by law, any liability which cannot be excluded is limited to the cost of the resupply or refund of the cost of the relevant services.
Use of Program Software
28. The Program software, including the App, is not a medical device and is provided for informational and educational purposes only.
29. Information accessed via the Program software is not intended to provide personalised medical diagnosis or patient-specific treatment advice. It should not be relied upon as a basis for diagnosis, monitoring, management, or treatment of any disease or medical condition. You should always follow the instructions of your healthcare professional.
30. All software included in the Program is owned by the Administrator and was developed in collaboration with the Company. You are granted a non-exclusive licence to download, install, access, and use the software solely in connection with the services you receive under the Program. You must not use the software for any purpose other than as expressly permitted under these Terms. No ownership of intellectual property rights or other commercial benefits is conveyed to you by using the software.
31. When using the Program software, you are responsible for:
Ensuring you are using the latest available version;
Any damage to your devices, and any loss or corruption of information stored on your devices, resulting from use of the software or interaction with other applications, data, or programs; and
Maintaining the physical security of your devices and the integrity of your data, including by ensuring you use a strong password and do not share your password with any other person
32. You must not:
Modify, edit, improve, resell, reverse engineer, or otherwise interfere with the operation of the software;
Systematically copy or widely distribute content from the software to the public; or
Violate these Terms in any other way.
33. The Company does not control and does not endorse the content of any websites to which the Program software may be linked. Your access to such websites is at your own risk. The Company accepts no liability for the accuracy, legality, or content of third-party sites, or for any third-party privacy practices.
Access
34. In order to use the App, you may need access to the Internet, either directly or through devices that access web-based content. Such access may not be available if you do not have an Internet connection or for other reasons. Your access may also be compromised if you do not have stable Internet connectivity.
35. You acknowledge and agree that by using the Internet to use the App, you may incur charges from your wireless carrier, Internet service provider or other method of internet access, depending upon your contract or plan with your provider. You acknowledge that payment of any such charges or any service fees associated with such access will be your sole responsibility.
36. In addition, you must provide all equipment necessary to make such a connection to the Internet. You agree that your use of the App will be in accordance with all requirements of, and separate terms provided to you by, your chosen wireless carrier, Internet service provider or other method of Internet access.
Questions Regarding The Medication
37. If you have any questions or concerns regarding your treatment with your Medication, you should speak with your healthcare professional.
38. You may also refer to the Consumer Medicines Information (CMI) for your Medication for additional guidance regarding your treatment.
General
39. Applicable Laws - These Terms are governed by and construed in accordance with the laws of New South Wales, Australia and the parties submit to the exclusive jurisdiction of the courts in New South Wales.
40. Severability - If any provision of these Terms is held by a court of competent jurisdiction to be invalid, such provision shall be reformed to as closely as possible approximate the intent of the parties and all other provisions shall remain in full force and effect.
41. Waiver - The Company's failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
42. Headings - Section headings in these Terms are used solely for the convenience of the parties and have no legal or contractual significance.
43. Agreement – You hereby represent and warrant that you are legally bound by these Terms whenever you download, install, access and or use the App.
ORGANON Care Patient Privacy Statement
ORGANON Care (“Program”) will be administered via an app titled ORGANON Care (the “App”).
The App may collect personal information relating to you (including personal sensitive or health information), which may include but is not limited to:
Full name
Date of birth
Gender
Contact telephone number
Email address
Residential address
Postal address
Username and password
Medical testing results
Medical condition
Medication you are taking or have been prescribed
By entering your personal information into the App, you consent to the collection, use, and disclosure of your personal information by the Administrator for the purposes of administering and managing the Program, including:
Receiving communications from the Administrator, including but not limited to push notifications, phone calls, mail, email correspondence, and SMS messages.
The Administrator providing the Company with de-identified reports, including your initials and relevant healthcare provider information (including treatment details), to allow the Company to meet quality, safety, audit, or inspection requirements.
The Company may also use aggregated and de-identified data for internal purposes, including planning and managing Program resources.
Your personal information will be stored in the Program database in accordance with these Terms of Service. The Administrator may also disclose your personal information to other persons involved in the Program, including third-party service providers or subcontractors approved by the Company. The Administrator may use your personal information to contact you as necessary, clarify details, or review your experience and participation in the Program.
Personal information collected through the Program is stored securely in Australia. Certain information, such as device identifiers and push notification tokens, may be processed by third-party service providers (e.g. Apple and Google) on servers outside of Australia, primarily in the United States, to deliver push notifications. By participating in the Program, you consent to this limited transfer and processing. The Company ensures that any third-party service providers have appropriate agreements in place to maintain the security and protection of your personal information.
You have the right to access, update, or correct your personal information and to opt out of receiving communications from the Administrator. For more information, please contact the ORGANON Care Support Program on 1800 295 259 or at support@organoncare.com.au.
Cookies and Analytics
When you access or use the App, the Administrator may use technology, including cookies, that can recognise, collect and/or transmit information that is associated with you, but which does not personally identify you. This type of information includes: your IP address, the internet or web domain that referred you, the type of operating system and browser you are using (including versions), the date and time of your visit, data relating to activities on the App and other technological attributes about your visit to and use of the App.
This information may be used, without limitation, to analyse trends, administer the App, track user movements, enhance security and optimise user experience. You can disable cookies or adjust your browser settings to stop automatically accepting cookies; however, this may affect your ability to use certain features of the Application.
Protection of Personal Information
The Administrator maintains commercially reasonable standards of security and confidentiality. The Administrator also tries to limit access to personal information to individuals who need to have such access to perform their responsibilities associated with the App.
The Internet and communications cannot be guaranteed to be secure and it is possible that others may unlawfully intercept or access information, transmissions or communications to, from or within the App.
You must provide certain personal information comprising at a minimum your email address, in order to enrol in the Program. Information that you record in the App is stored locally on your mobile device such as iPhone, iPod touch, mobile phone, iPad iOS, and/or Android smartphone devices, and will also be stored securely on RxPx servers using encryption. It may be possible for your device to be linked to you through identifiers associated with your device, however, neither the Company, the Administrator nor any third party will use this information to identify you. If you choose to record your full name or other information that directly identifies you, we recommend that you use the lock/device security feature on your device to protect the personal information stored on your device.
ORGANON Care Patient Safety Statement
The Company is committed to patient safety. In accordance with regulatory obligations, the Company processes reports of adverse events experienced by patients using an Organon medication when identified by a Company representative or a third party acting on behalf of the Company.
The Company’s Patient Safety team may contact you or your healthcare professional to collect further information regarding any adverse event. This information may be shared with regulatory authorities, other pharmaceutical companies with which the Company has licensing agreements, or third parties involved in safety reporting.
By participating in the Program, you acknowledge that you have read and understood this Patient Safety Statement and consent to the collection and use of adverse event information as described. You understand that any adverse events identified during your participation in the Program will be forwarded to the Company’s Patient Safety department for safety reporting purposes.
You further understand that the Patient Safety team may contact your healthcare professional to obtain additional information necessary for accurate and compliant reporting of any adverse events.
